Probationers Get Fairer, Tailored Rules

Arizona courts and probation officers must set conditions that fit each person, unless another law requires otherwise. Conditions must support lawful behavior, public safety, or rehabilitation and use a validated risk assessment. A presentence report must also inform conditions if one was prepared. Decision-makers must consider waiving unnecessary standard conditions; special conditions must be supported by the case record and no stricter than reasonably needed.
