Public employees convicted of a felony for misconduct from their official duties lose all accrued pension and retirement benefits. This includes misconduct tied to getting the job, pay, or retirement benefits. The forfeiture applies to any public retirement system the person is in. It takes effect on the date of conviction under state forfeiture rules.
Public employers must keep investigating on‑duty misconduct even if the employee retires. If the review shows the employee may have committed a crime, the employer must refer the case to law enforcement. After that referral, the employer may close the administrative case. These rules apply to misconduct arising from official duties.
