People with felony convictions or certain offenses cannot own or control firearms. A federal felony counts only if it matches a California crime or carried over 30 days’ custody or a $1,000 fine. Some out-of-state nonviolent felonies do not trigger the ban if the state cleared the record and restored gun rights. A full, unconditional pardon that restores civil and firearm rights can also remove the ban if no weapon felony.
Beginning April 1, 2026, dealers must wait at least 10 days before delivering a firearm. They must refuse delivery if DOJ flags you as prohibited or you lack a safety certificate. Starting then, dealers also must block delivery if it would give you more than three guns in 30 days. At delivery, the gun must be unloaded and secured; you must show valid ID and age. Older delivery rules stop operating April 1, 2026 and are repealed January 1, 2027.
The law bans firearms and other listed weapons in public transit facilities. Exceptions cover on-duty officers, authorized transit security, and unloaded guns checked under system rules. Breaking the rule can mean up to six months in jail, a fine up to $1,000, or both.
Sheriffs and police chiefs must issue or renew carry licenses for qualified residents and nonresidents. You must be 21, not disqualified, finish required training, and be the recorded owner of each listed gun. Nonresidents must swear the local area is a main California place they visit and complete live fire for each gun. Agencies must confirm gun ownership in DOJ records before issuing or renewing. In counties under 200,000 people, sheriffs may issue a county-only loaded-and-exposed license, and may let city chiefs process city residents’ applications.
DOJ must run fingerprint checks for all new applicants before any license issues. For renewals filed on or after September 1, 2026, fingerprints and the fee must go to DOJ again. Licenses cannot issue or continue if DOJ finds you are prohibited; DOJ must notify local agencies within 15 days. If denied or revoked, the agency must tell you how to appeal and the 30‑day court deadline. Agencies must keep and send records to DOJ, and DOJ may use emergency rules for up to two years.
You must pay a state DOJ fee set to cover processing costs. Your city or county may also charge its reasonable processing and enforcement costs. They can collect up to half at filing and the rest only if a license issues. If a psych exam is required, you pay the actual cost within set limits. Nonresidents may test virtually or with a provider within 75 miles.
