Faster name changes to match gender

Beginning July 1, 2026, adults get a court decision on a gender‑matching name change within six weeks and without a hearing. For minors, if all living parents sign, the court grants it within six weeks. If not all parents sign, people have six weeks to file a written objection; without a timely good‑cause objection, the court grants it without a hearing. The petition and order must be served on non‑signing parents within four weeks. Objections based only on gender identity or birth sex do not count as good cause. No newspaper publication is required.

One court filing for all changes

Beginning July 1, 2026, you can file one petition to change your name, recognize your gender, and request new birth or marriage records for you or your child. The court applies the name‑change and gender‑recognition rules in one case. After judgment, you must file certified copies with the Secretary of State and the State Registrar or county clerk within 30 days and pay any fees so new documents are issued.

Gender marker changes and required signatures

Beginning July 1, 2026, you can ask the court to recognize your gender with a sworn affidavit that counts as proof. For minors, at least one parent, a guardian, or a near relative or friend may sign; the child’s signature is not required. To change an adult child’s birth certificate, the adult child must sign. A spouse must sign or be notified to reissue marriage records. If not all parents sign, the court orders notice (or notice to grandparents if parents cannot be found), gives six weeks to object, and requires service within four weeks. Objections based only on gender identity or birth sex are not good cause; if a parent objects to a child’s birth certificate, the judge may deny changes not in the child’s best interest. Guardian‑signed cases go to the court with the case, and the judge must find the guardianship is likely to last until adulthood. If no service is needed and no timely objection is filed, the court grants the petition without a hearing.

New birth and marriage records and fees

Beginning July 1, 2026, after a court order, you must file a certified copy with the right office within 30 days and pay required fees. The State Registrar issues a new birth certificate for you or your child that shows the court‑ordered name and gender and does not show it is amended. For non‑confidential marriages, the State Registrar issues new licenses; for confidential marriages issued in‑state, the county clerk does and cannot charge more than the normal fee or reasonable cost. New marriage records show any court‑ordered designation and name; if the old “New Names” box does not match, that box is left blank.

Old procedures end by January 2027

On July 1, 2026, the prior name‑ and gender‑change sections stop operating. They are fully repealed on January 1, 2027. The new rules in this law apply instead.
