The law defines two crimes after a deadly DUI crash. Gross DUI manslaughter applies when a death results from extreme carelessness during an unlawful act, or a lawful act done unlawfully. The lesser DUI manslaughter applies when there is no gross negligence. Both require the driver was violating Vehicle Code 23140, 23152, or 23153.
The law sets prison terms for DUI killings. Gross DUI manslaughter carries 4, 6, or 10 years in state prison, unless the repeat‑offender life term applies. The lesser offense can mean up to 1 year in county jail, or 16 months, 2, or 4 years in prison. If probation is granted for any conviction under this section, it must last 3 to 5 years.
The law sets a 15‑years‑to‑life sentence for people convicted of gross DUI manslaughter who have qualifying prior DUI or manslaughter convictions. Standard prison credit rules under Article 2.5 apply to reduce the term. To use this life term, prosecutors must put the triggering facts in the charge, and those facts must be admitted in court or found true by the judge or jury.
