The law makes it a crime to force someone to marry you or someone else by force, menace, or duress. It is punishable by imprisonment under California’s sentencing rules. The rule applies the same way no matter the victim’s age. It removes an outdated offense and focuses the law on forced marriage.
Beginning January 1, 2027, the law sets who can ask a court to declare a marriage null and the filing windows for each ground. If you married while underage, you can file within 4 years after you reach the age of consent; a parent, guardian, or conservator can file before you reach that age. If consent was by fraud, you have 4 years after discovery; if by force, you have 4 years after the marriage. Courts can also allow late filings in forced‑consent cases for good cause, and Judicial Council forms are updated to support this. The current rules stay in place until January 1, 2027, when they are repealed and replaced.
