Cities and counties can pass rules to allow a junior accessory unit on single-family lots. They can require a permit to create the unit. Only one junior unit is allowed per single-family lot, and the lot must have a home built or proposed. This law enables local permission but also limits the number of units.
If the junior unit shares bathrooms or plumbing with the main house, the owner must live on the property. The owner can live in the main house or in the junior unit. Owner occupancy is not required if the junior unit has separate sanitation, or if the owner is a government agency, land trust, or housing group. A deed restriction must be recorded and filed with the permitting agency. It must ban selling the junior unit separately and limit its size and features to the law. Any rental of a junior unit must be for more than 30 days.
A junior accessory unit must be built within the walls of the existing or proposed house. Enclosed areas like attached garages count as part of the house. The unit must have its own entrance separate from the main entrance. If it has no separate bathroom, it still needs a separate entrance and an interior entry to the main living area. If rented, it must have an efficiency kitchen with appliances, a food prep counter, and cabinets sized for the unit.
