4 provisions identified: 1 benefits, 1 costs, 2 mixed.
Law schools cannot charge you extra fees for externship placement beyond tuition. Doing an externship does not require you or the employer to promise future employment.
If you are in a paralegal certificate program, these pay‑and‑credit externship rules do not apply. Paralegal students cannot claim payment under this law.
Beginning August 1, 2026, law schools must let you get paid while earning externship credit. You must be in good academic standing to receive pay. Employers choose whether to pay; the law does not require payment or change credit standards. Externships can be in person, hybrid, or remote, and can be in or out of California. The rules apply to ABA- or California‑accredited schools that receive or benefit from state student aid or enroll students who get that aid. For the University of California, these rules are requests to the Regents.
When an employer pays a law student for a for‑credit externship, the employer does not have to provide workers' compensation or similar benefits under this law. Paid externs may not receive those employer benefits.
