Emergency seizure meds in adult facilities

The law lets adult residential facilities and adult day programs allow a trained administrator or volunteer to give prescribed intranasal seizure medicine during a seizure, if the client or their representative asked. The facility must have a current, signed seizure action plan with the doctor’s directions; the authorization is valid for the calendar year and renewed each year. The medicine must arrive with the pharmacy label attached, and the plan must say how and where to store it. Each dose must be recorded in the client’s medication file, and facilities must have written policies that follow each client’s plan. If no trained staff or volunteers are available, the facility must tell the client, their representative, or the regional center coordinator to arrange other care.

Free seizure-response training for staff

By January 1, 2028, the Department of Social Services sets minimum training standards to spot and respond to seizures. The standards cover giving or helping with intranasal seizure medicine, follow‑up steps, and clear written materials. Training for administrators and authorized volunteers must be free and done during regular work hours. Facilities must keep proof of training under state licensing rules, and keep the written materials in a central place for staff.

Legal protections for seizure volunteers

If a facility allows staff or volunteers to give the intranasal medicine, it must give them written defense and indemnification from civil claims. People who act in good faith, without pay, and follow the law are protected from civil, criminal, and professional liability. These protections do not cover gross negligence, willful misconduct, crimes, or actions not allowed by this law. An administrator or volunteer can rescind their offer to volunteer at any time without penalty or retaliation. The facility must give written notice of these rights and keep it in the person’s personnel records.
