Late payment rules change for state vendors

The law updates late-fee rules for companies and nonprofits that bill California state agencies. If the Director of Finance finds the state cannot pay on time because of a major calamity, disaster, or criminal act, late penalties are suspended until the Director restarts them. This pause does not apply to resource conservation districts, certified small businesses, nonprofit organizations, nonprofit public benefit corporations, or small businesses and nonprofits that provide Medi-Cal services or equipment. When there is no enacted Budget Act and a payment is late, penalties keep adding up until the bill is paid; nonprofit public benefit corporations cannot collect penalties in that case. For contracts with the Department of Forestry and Fire Protection, invoices that would be late during the agency’s peak fire staffing period get a 30-day extension on the payment-approval date; this delay does not apply to resource conservation districts, certified small businesses, nonprofits, or nonprofit public benefit corporations.
