The Standards Board remains the state authority to set firefighter gear rules. The Department convenes an advisory group by January 1, 2016, gives recommendations by July 1, 2016, and the Board decides by July 1, 2017. Starting July 1, 2018, and every five years, the Board reviews NFPA updates and must decide on rule changes by July 1 of the next year when they offer better protection. DOSH reports progress to the Governor and Legislature by July 1, 2026.
By January 1, 2028, the Standards Board considers changes to remove gear rules that force use of PFAS and similar hazards. New standards rely on scientific research and use the 2025 NFPA 1970 as a floor. Future-certified gear must be free of PFAS and certain flame retardants, and makers must certify compliance. Auxiliary gear starts later than garments. Current gear phases out by normal wear or within 10 years after the change. The law defines auxiliary PPE (like breathing, hearing, and fall-protection gear) and firefighting garments (jackets, pants, boots, gloves, helmets).
