The law limits what you can be charged after a rental car is damaged or stolen. For collision damage, you never owe more than the car’s fair market value (what it would sell for). For theft, you owe up to fair market value unless the company proves, by clear and convincing evidence, you failed to use ordinary care. If an authorized driver returns the key, files a police report within 24 hours, and cooperates, you are presumed not liable for theft; the company can rebut this only by showing an authorized driver committed or helped the theft. Vandalism tied to a theft is capped at fair market value, and you owe nothing if you have no theft liability. Vandalism not tied to theft is capped at $500 per incident. If you are liable, you must also pay the actual towing, storage, and impound charges the company paid, plus any administrative charge for appraisal and related costs.
The law sets strict limits on how companies use data from rental cars. GPS navigation can be in the car, but the company cannot use navigation data about your driving, except to find or fix a defect. For remote lock/unlock and roadside help you request, the company may use only the data needed to provide that service. Companies may use telematics only to record when the car left and returned, total miles, and fuel level, and only for those purposes. They may not track you to impose fines or surcharges.
Rental companies may not use electronic tracking except in narrow cases listed in your rental. They can turn it on to find a stolen, missing, or unreturned car after you or police report it, if it is not returned 24 hours after the due date (after a 24‑hour prior phone and electronic notice unless you gave no phone or consent), or if it is still unreturned after one week. They can also activate tracking if they discover the car is stolen or abandoned and file a police report, or if the car is part of an AMBER Alert. They may use geofencing to detect travel outside the country when not allowed and to detect cars in impound lots; after notice, if the car stays in an impound for 24 hours, it is deemed abandoned. Your rental must advise you that tracking may be used and require your initials (with special rules for membership programs and for in‑person or phone bookings). When tracking is used, the company must keep a record for at least 12 months and share it with you on request; no record is required for thefts outside your rental period. Companies may give tracking data to police only with a subpoena or search warrant.
