State lawyers for immigrant youth

California provides legal counsel to eligible immigrant youth when state funding is available. You qualify if you live or used to live in California and are an undocumented minor under federal law, or you are under 18 with no lawful status and either arrived without a parent or have no parent or guardian available to help in your immigration case. Help starts when a federal or state agency, or an immigration lawyer, identifies you as unaccompanied. It covers state court cases, filings for needed orders, federal immigration hearings, related appearances, and appeals before DHS, federal court, or the Department of Justice. If you already have your own lawyer, the state does not assign one. If a lawyer is assigned before you turn 18, it stays through the whole case.

Legal groups prioritized for contracts

The department allocates funding for legal services and must consider whether federal funds were made available and paid out in California. It prioritizes qualified nonprofit legal groups that cannot get federal funds or still have unmet needs. The department may contract with those nonprofits or with a county public defender’s office that meets strict experience rules. A qualifying public defender must have an immigration attorney with at least 3 years of experience, who has handled at least 20 minors’ cases, has removal and asylum experience, and has trained other practitioners. The department may add other eligibility rules.

Social work funding and insurance rules

The department may pay for social work services when a qualified nonprofit legal group hires them to help immigrant youth. Contractors that provide legal services must carry legal malpractice insurance. Contractors must also protect the state from claims tied to their work.
