Experienced nonprofits lead immigrant outreach

Outreach grants must go to nonprofits with 501(c)(3), 501(c)(5), or California 23701d status. Groups must have at least three years of outreach with immigrant communities and three years of outreach for government benefits and programs.

More nonprofits can get immigrant-service grants

The law treats California 23701d charities the same as federal 501(c)(3) groups for state and local grants and contracts. The social services department may award grants to nonprofits that meet 501(c)(3), 501(c)(5), or California 23701d rules, and partners can qualify together. A qualified nonprofit now includes either a federal 501(c)(3) or a California 23701d charity, plus any extra rules the department sets. This expands which local groups can get funding and provide services.

New resettlement help for asylees

The law creates the Enhanced Services for Asylees and Vulnerable Noncitizens program. It funds resettlement help for people in California who have asylum or qualify under state rules. Nonprofits must have 501(c)(3), 501(c)(5), or California 23701d status and at least three years of case management and culturally and linguistically appropriate services. The department monitors services and may fund a formal evaluation.

Stronger rules for immigration legal help

Only nonprofits with 501(c)(3), 501(c)(5), or California 23701d status can get grants for immigration legal services. Most must have at least three years of experience on the type of immigration issues handled, give trainings beyond staff, and be OLAP-recognized or meet State Bar Trust Fund rules. Groups that provide legal training and technical help generally need 10 years’ experience unless the department allows the three-year standard. Grantees must keep legal malpractice insurance, indemnify the state, and accept reporting, monitoring, and audits.

Experienced providers for health and aid services

To run medical screening, a provider must have at least three years of medical screening or similar health care experience. For other help, a provider needs three years of experience or must subcontract with an experienced group. Medical screeners may also subcontract to meet the experience rule.

Upfront grant payments capped; funds add services

No more than 40% of each grant or contract is paid up front. State funds must add to, not replace, other immigrant-assistance money. With the department’s consent, older grants can cover the newly listed services without a new award.
