You can cancel a home solicitation or seminar sale until midnight of the third business day after you sign. If you are 65 or older, you have until midnight of the fifth business day for contracts entered on or after January 1, 2021. Sellers must use the same language as the sales talk, date and sign the contract, list their name, address, and email on the first page, give you a copy, and provide a duplicate Notice of Cancellation. They must also tell you about your right to cancel, and you can cancel until they do. To cancel, send a written notice to the seller’s address or email in the contract; mailed notices are effective when posted, and you do not have to use the form.
If your home was damaged in a disaster, you can cancel a repair or restoration deal until midnight of the seventh business day after you sign. If you buy a personal emergency response unit (a stand‑alone alert device), you also get seven business days to cancel. This seven‑day right does not apply if the device is installed as part of a licensed home security alarm system. For disaster repairs, this right does not apply in transactions covered by Civil Code Section 1689.15.
When a seller calls you, they must give the full street address they are calling from and, if different, their main office address. If they say an item was given for free, they must tell you how many people actually got the highest‑value item in the last 12 months (or while in business). These rules apply to calls to buyers in California.
Your contract must say if subcontractors will be used. If yes, you can ask for a list with each subcontractor’s name, contact info, license number, and license type. Each change order must show the same notice.
The prime contractor is responsible for completing your home improvement project as agreed. The licensing board can hold the prime contractor primarily accountable. This does not stop action against subcontractors or salespeople when they violate the rules.
For certain home improvement contracts, you can cancel until midnight of the third business day after you receive a signed, dated copy that meets the rules. If you are 65 or older, you have five business days for contracts entered on or after January 1, 2021. For service and repair deals, you can cancel until you get a conforming signed copy and until work starts. If the service and repair form does not meet the required format, the standard home improvement rules apply no matter the total price.
Some changes to home improvement contract rules take effect only if this law and Senate Bill 517 both become law and are effective on or before January 1, 2026, and each changes the same section. This law must also be enacted after Senate Bill 517. If all are true, Section 1 of this law does not take effect.
