Licensed alcohol and drug treatment facilities must report any resident death fast. They must call the health department within one working day. They must send a written report within seven calendar days. Reports must describe what happened: time, place, and nature. They must list actions taken and who was contacted, and planned steps to prevent another death. Any new, relevant facts must be sent within 30 days of the initial incident.
The health department keeps a policy to investigate resident deaths in licensed facilities quickly. If investigators find violations, the department must send the facility a written deficiency notice. The notice must say how to fix the problems and by when. The department can use all-county letters, provider bulletins, or similar guidance. It can do this without formal rulemaking, so guidance reaches facilities faster.
