The Legislature now funds trial courts each year based on a Judicial Council request. The request must meet court needs and includes a growth amount tied to the state appropriation limit. The Judicial Council must report court operations to the Legislature by February 1 each year. Courts must send revenue, spending, reserves, and fund balances by September 15. A public summary is due online by December 31 after each fiscal year.
The law creates the State Trial Court Improvement and Modernization Fund. It replaces two older funds, earns interest, and pays for approved court projects. Each year, $13,397,000 moves from this fund to the Trial Court Trust Fund to support court operations.
For the 2025–26 fiscal year, the law gives $4.69 million from the General Fund to the State Court Facilities Construction Fund. This is a one-time backfill to support court facility needs that year.
The Judicial Council can make short-term loans to the Trial Court Trust Fund when cash is low. Loans can total up to $150,000,000 outstanding, charge no interest, and must be repaid within two years. Courts must first have a balanced budget approved by the Judicial Council. Loan details must be reported each year by August 30.
The law repeals Code of Civil Procedure Section 241, ending the juror compensation and mileage pilot and its reports. It also repeals Government Code Sections 68604 and 77001.5 to clear out old court rules. Ending the pilot removes a state study that tested higher juror pay and travel reimbursement.
The Judicial Council may sell several named court buildings at fair market value. The county gets the first chance to buy them at that price. Net sale money goes to the State General Fund. Listed sites include Portola, Modesto, and Ceres locations.
