The law bars California lawmakers, when acting in their official role, from signing or asking for nondisclosure agreements about drafting, negotiating, or discussing proposed laws. Any such agreement made or requested after the law’s effective date is void and cannot be enforced. NDAs are still allowed, and remain enforceable, if they only protect trade secrets, financial information, or other proprietary information. This rule applies only to Members of the Legislature acting in their official capacity.
