Eviction motions: short timelines and tenant options

In eviction cases, by your court date you can answer, demur, or move to strike the complaint. If you file a demurrer or motion to strike, the hearing is set 5 to 7 court days after you file the notice, and you must serve all papers with the notice. The parties can agree in writing to move the hearing; for homes the court may delay for good cause with court‑set notice, and for business rentals any good‑cause delay cannot go past 10 court days after the first hearing date. You may oppose in writing or speak at the hearing; to have a written opposition reviewed early, file and serve it by the court day before the hearing using delivery that reaches the other side by close of business. The court may still consider late papers.
