Paid EV chargers cannot force you to buy a membership. The station must show the total price at checkout, including any roaming fees for nonmembers. For chargers first installed or first open to the public on or after July 10, 2023, the law requires contactless credit or debit card payment without an app, plus either a toll‑free automated phone line or SMS to start and pay. Stations may still offer memberships, but they cannot require one. The energy commission can update the required payment options as technology and costs change.
If no national roaming billing standard existed by January 1, 2015, the energy commission may set roaming billing rules. If it does, all paid stations must comply within one year. Any roaming standards apply only to major providers that manage at least 100 public stations in the state, and the commission may raise that threshold. The standards must let drivers from one major network or automaker pay on another major network, while allowing providers to use bilateral or hub‑based roaming deals.
Charging stations must follow federal labeling rules in 16 C.F.R. Part 309. Where commercially reasonable, stations can also have clear signs in the parking area. Providers must report each station’s location, fee schedule, accepted payment methods, and any roaming fees for nonmembers to NREL.
DC fast chargers first installed or first open to the public on or after July 10, 2023 must support Plug and Charge. They must meet the ISO 15118 Plug and Charge standard by July 10, 2024.
A charger on the grounds of an arena with at least 15,000 seats may require you to pay only through an internet app, but only if access to that charger itself is limited to that app. This exception becomes operative only if both AB 1423 and SB 533 are enacted and effective on or before January 1, 2026, both amend Health and Safety Code Section 44268.2, and AB 1423 is enacted after SB 533. If those conditions happen, the earlier version of this section does not take effect.
