Bill Overview

Analyzed Economic Effects

4 provisions identified: 0 benefits, 1 costs, 3 mixed.

Getting back an expired certificate

If your certificate expires, you can renew it any time within four years by filing an application, and it takes effect the day you file. If you apply more than 30 days late but within four years, the department renews it if you give a written reason it accepts. After four years, you must complete a certification training program and pass any required exam, unless the department finds no reason for discipline and you pass the exam. A suspended certificate can be renewed but you cannot work until it is reinstated. A revoked certificate cannot be renewed.

Ongoing renewal rules for aides

Home health aide certificates renew every two years and expire on your birthday. To renew, you must get a criminal record clearance and show at least 12 hours of in‑service training in each 12 months. Apply on time using the department’s form. The department sends written notice 90 days before your renewal date, but not getting a notice does not excuse a late renewal. Tell the department about address changes within 60 days, and renew nurse assistant and home health aide certificates together on one application if you hold both.

Stronger rules for online aide training

Online home health aide programs must teach live with students and approved instructors online at the same time. Programs must verify identity, protect personal data, publish tech needs, have backup plans for tech issues and absences, and share student results like exam pass rates with the department. Online programs must meet the same standards as classroom programs, and the department can set details by All Facilities Letter. Programs must also give the department access to monitor online sessions.

Who can teach aide classes

Home health aide instructors must be registered nurses with at least two years of nursing, including one year in home health. A licensed vocational nurse may teach under the general supervision of such an RN. The law does not require a separate teaching credential for these instructors.
