If you are a charging party, respondent, or intervenor in a VTA unfair‑practice case, you can ask the court to review a final PERB order. This does not cover PERB’s choice not to issue a complaint. You must file in the district court of appeal for a VTA county within 30 days of the final order or the order denying reconsideration. After filing, PERB must send the certified record to the court within 10 days, and the court can grant temporary relief and enforce, change, or set aside the order. The court treats PERB’s fact findings as final if supported by substantial evidence, and normal state writ rules apply unless this law says otherwise.
After the 30‑day review window closes, PERB can ask a court of appeal or a local superior court to enforce a final order. If a party asks why PERB has not enforced, PERB must answer within 10 days. If PERB’s answer does not show compliance and you ask, PERB must seek enforcement and file the record and proof of noncompliance. After a hearing confirms PERB followed its procedures and someone still refuses to comply, the court must enforce by writ or other process and cannot re‑decide the order’s merits.
