Contractor rules for real estate and inspectors

The law keeps the ABC test from applying to some regulated jobs. Real estate licensees follow separate rules; if a key section does not apply, unemployment uses UI Code rules, workers’ comp follows Labor Code, and Borello applies to other Labor Code issues. A responsible broker’s statutory duties do not count as Borello factors. Home inspectors under state law and licensed repossession agencies are also excluded; repossession agencies must be free from the hiring party’s control to be independent.

Freelancers and beauty pros use contractor test

The law changes how many freelance “professional services” are classified. When six facts are met—separate business location, required licenses, setting your own rates and hours, serving other clients, and using independent judgment—the Borello test applies instead of the ABC test. Covered fields include writers, editors, translators, photographers, marketers, HR, appraisers, enrolled agents, travel agents, and more, often with a written contract. Licensed beauty pros must set their own rates, take client payments, keep a business license and client list; if they work at a salon, they must issue a Form 1099 to the salon owner. EDD and the Labor Commissioner must report to the Legislature by June 1, 2026 on manicurist misclassification since January 1, 2020. The manicurist subparagraph is inoperative on January 1, 2029.
