New financing for California FAIR Plan

The state’s I‑Bank can issue bonds, loans, or credit lines for the California FAIR Plan. Money can pay claims and boost cash so the Plan can handle disasters. With approval from the Insurance Commissioner, the Plan can pledge premiums, receivables, assessments, and other assets as collateral. The Commissioner must approve requests and amounts before any financing happens.

Possible assessments on FAIR Plan members

If the FAIR Plan cannot make payments on approved bonds, loans, or credit lines, it must assess its members enough to pay on time. The Insurance Commissioner must review and approve these assessments before they are charged.

Streamlined oversight for FAIR Plan financing

The Insurance Commissioner keeps control over insurance matters. The I‑Bank handles financing and can enforce loan agreements but does not regulate insurance. Certain government code rules do not apply to these I‑Bank financings. While any related bond, loan, or credit line is outstanding, the FAIR Plan is exempt from two Insurance Code articles.

Stronger investor protections, no state backing

Bonds for the FAIR Plan are not state debt. They are paid only from pledged FAIR Plan revenues and assets. Once the Insurance Commissioner approves repayment terms, the Plan cannot change them to delay or reduce payment. A statutory lien automatically attaches to the collateral and is enforceable without extra filings.
