FAIR Plan help if you can’t get insurance

Insurers must set up the California FAIR Plan within 30 days of the law taking effect. If you cannot get basic property insurance after a diligent effort in the normal market, you can apply to the FAIR Plan for basic coverage. This gives homeowners in hard-to-insure areas a way to get insured.

FAIR Plan funding, limits, and cost‑sharing rules

With the Insurance Commissioner’s approval, the FAIR Plan can assess all member insurers to fund operations. The Plan can set maximum coverage limits and underwriting rules to decide if a risk is insurable. It sets the commission paid to the licensed producer named by the applicant. When sharing costs among insurers, it cannot count premiums from auto insurance, commercial farm commodities or livestock, or farm equipment.

Who runs the California FAIR Plan

A nine‑insurer governing committee runs the FAIR Plan. Four nonvoting members are appointed by the Governor: one each for agents, brokers, surplus line brokers, and the public. The Assembly Speaker and the Senate Rules Chair are nonvoting ex officio members and may name a designee. This adds industry, public, and legislative voices to oversight.

All property insurers must back FAIR Plan

Any insurer that sells basic property insurance in California must join and support the FAIR Plan. Joining is required to keep their authority to sell that insurance. This helps keep FAIR Plan coverage available for people denied elsewhere.
