Eviction pause for Social Security rent hardship

You can raise a "Social Security hardship" defense in eviction court for unpaid rent. You must prove your household’s Social Security was stopped, delayed, or cut through no fault of yours. You must also show that caused the missed rent. If you meet these proofs, the court pauses the case. The pause lasts until 14 days after benefits return, or six months. This applies to homes and mobilehome park units. It only covers cases based on nonpayment of rent.

Pay past rent or plan in 14 days

The law does not erase back rent. Within 14 days after benefits are restored, you must act. Pay all past rent or enter a payment plan with the owner. If you do that on time, the court restores your tenancy. The court dismisses the case or sets aside any judgment for everyone named.

Protections end January 20, 2029

These protections stay in place until January 20, 2029. After that date, the defense, pause, and repayment rules end unless extended.

Court forms ready by 2027

Courts must have updated forms by January 1, 2027. The forms explain how to claim hardship and ask for a pause. They also cover repayment or a payment plan.

Governor can still order eviction relief

The law keeps the Governor’s emergency powers. The Governor can still declare an eviction moratorium. The Governor can take other emergency steps for Social Security hardship.
