Adult claims revived 2026-2027, cover-ups liable

Beginning January 1, 2026, adult sexual‑assault claims that would be time‑barred are revived if they are pending on that date or filed between January 1, 2026 and December 31, 2027. You can also sue entities that are legally responsible and engaged in a cover‑up—meaning a concerted effort to hide evidence, including using nondisclosure or confidentiality agreements. Related claims like wrongful termination and sexual harassment tied to the assault are revived too. This revival does not include cases already finally decided or settled before January 1, 2026. It also does not revive claims against public entities, and public agencies do not have to indemnify perpetrators.

Longer filing time and 2026 revival for adult survivors

If the assault happened on or after your 18th birthday, you can file by the later of two dates: 10 years after the last act, or 3 years after you discovered the injury. The law also revives time‑barred claims for conduct on or after January 1, 2009 that were or are started on or after January 1, 2019; you may file these through December 31, 2026. Revived cases do not include those already finally decided or settled in writing before January 1, 2023. You do not need a criminal case or conviction to sue. The law uses listed sex‑crime offenses in state law (and attempts or assault with intent) to define “sexual assault.”

Special windows for student and UCLA doctor claims

Claims over $250,000 for sexual assault or inappropriate contact by a doctor at a student health center (Jan 1, 1988–Jan 1, 2017) can proceed if they were pending on October 2, 2019, or were filed between January 1 and December 31, 2020. These student‑health claims exclude cases finally decided or settled before 2020 and do not allow suits against public entities. For those claims, your lawyer must file a sworn statement saying they reviewed the facts, consulted a mental‑health practitioner, and in good faith believe the claim exceeds $250,000 (with the complaint or by December 1, 2019 for pending cases). Separate rules revive claims against physicians employed by a UCLA medical clinic or with active privileges at a UCLA hospital for conduct from Jan 1, 1983–Jan 1, 2019, if the case was pending on January 1, 2021 or filed between January 1 and December 31, 2021; cases finally decided or settled before 2021 are excluded.
