The State Water Board can set emergency water rules to stop waste, boost recycling, require curtailment when water is not available under priority, or require reporting and monitoring. The board acts in a critically dry year that follows two or more dry years, or during a Governor-declared drought emergency. Each rule lasts up to one year and can be renewed only while those drought conditions continue. The board must end a rule when it is no longer needed. The Office of Administrative Law does not review the board’s emergency findings, allowing faster action.
Beginning January 27, 2025, Article 23.5 stays in effect for the Scott and Shasta River watersheds. It ends on January 1, 2031, or sooner if permanent long-term instream flow rules are adopted. The State Water Board gives yearly public updates and takes public comments on progress toward those permanent rules.
Breaking an emergency water rule is an infraction with a fine up to $500 for each day of violation. Civil penalties for breaking emergency conservation rules go into the Water Rights Fund and can be used for conservation when lawmakers approve. An “emergency conservation regulation” can make end users, water retailers, or wholesalers conserve water or report on conservation. It does not include curtailment when water is not available under a diverter’s priority, or reports that only relate to curtailments.
