You can appeal if a permit is denied, called incomplete, or called noncompliant. Appeals must get a final written decision in 60 business days for projects with 25 units or fewer, and 90 business days for 26 units or more. If a state agency misses legal time limits, the permit and related reviews are deemed approved and complete. If a local agency misses time limits, it violates state housing law. Agencies cannot force you to sign deadline extensions to accept your application. You may agree to an extension, and an agency may require one only to allow concurrent processing or environmental review for the same project.
Agencies must post what information you need for post‑approval permits and show a complete, approved example. Local agencies had to post by January 1, 2024 and include at least five types: ADU, duplex, multifamily, mixed use, and townhome. State agencies must post by January 1, 2026. This makes it easier to file a complete application the first time.
The law speeds up permits after a project is approved. Agencies have 15 business days to say if an application is complete. If they miss that, it is treated as complete. Small projects (25 units or fewer) must get a decision or full comments in 30 business days. Larger projects (26 or more units) get the same within 60 business days. Agencies can pause the clock only when they need an outside review and must email you within 3 business days to say the clock is paused. They can also take more time only with written proof of a specific, serious risk to health or safety. If your complete filing is denied or not compliant, the agency must list fixes, and you can resubmit. Once the agency finds your permit compliant, it cannot be sent to more appeals or extra hearings.
The rules cover housing projects that are at least two‑thirds residential. They include nondiscretionary permits needed to start work, like building (including Title 24), demolition, minor grading, minor off‑site work, and interdepartmental reviews. They do not cover Coastal Commission permits, special district permits, utilities not run by a city or county, or certain water‑quality and drinking‑water permits. Local agencies may set written thresholds for what counts as a minor or standard permit. If your project also uses the state’s streamlined approval law for housing, those post‑approval permit rules apply too and must align with this section.
