In a lawsuit against someone who developed, modified, or used the AI that caused harm, the defendant cannot argue the AI acted on its own. Defendants can still use other defenses and show evidence about cause or foreseeability. Parties can also show evidence about the fault of other people or companies. This rule applies under California Civil Code section 1714.46.
