It is now easier to bring an antitrust case in California. A complaint only needs facts that make a contract, combination, or conspiracy to restrain trade plausible. It does not need facts that rule out each company acting on its own. This standard applies to any case under the Cartwright Act despite any other law.
The law bans businesses from using or selling a common pricing algorithm to restrain trade in California. It also bans using or selling such tools to force another business to follow a price or other term the tool recommends for the same or similar products or services. A common pricing algorithm uses competitor data and is used by two or more people to set, align, or influence prices or terms. Distribute includes selling, licensing, or giving access, including by subscription. End consumers are not covered. Pay to employees or contractors counts as price under this rule.
