The law makes it a crime to willfully threaten to kill someone or cause great bodily injury. You must mean the words to be taken as a threat, and they must cause sustained fear. The threat must be clear and specific, and can be spoken, written, or sent by devices like phones, cell phones, or computers. “Immediate family” includes a spouse (married or not), parents, children, relatives by blood or marriage within two degrees, and people who live, or recently lived, in the home. Punishment is up to one year in county jail or imprisonment in state prison.
For felony criminal threats, judges can treat a threat as more serious if the victim is a known state constitutional officer, a legislator, a judge, or a court commissioner. This can make the felony sentence harsher within the allowed range.
