Local governments and the Commission must set agreements that cover paying the Commission’s direct and indirect costs. Before approval, the Commission sends the proposed agreement to the Department of General Services. The Commission may approve it 90 days after submission or after the department’s written review, whichever comes first, and then submits it to the Department of Finance. Agreements cannot include cancellation fees or liquidated damages. If the local agency ends the deal, it must pay for services already provided and reasonable prep costs. Either party can end an agreement by ordinance or resolution, effective 90 days after enactment unless a longer period is in the agreement. The Commission posts a public list of all local agencies with agreements on its website.
The law lets the state Fair Political Practices Commission take over a local agency’s campaign finance and ethics law by mutual agreement. Once approved, the Commission is the civil prosecutor. It can advise, audit, investigate, and bring administrative or civil cases. The Commission does not need further local approval to file actions. Any local law it enforces must follow the Political Reform Act, and the local body must consult the Commission before adopting or changing that law. This does not apply in places with 3,000,000 or more people. The law also repeals an older section tied to past local enforcement rules.
