Extra grant points for prohousing cities

For award cycles that start after July 1, 2021, prohousing cities and counties get extra points on key state grants. They must have a housing element in substantial compliance and hold a prohousing designation. Programs include Affordable Housing and Sustainable Communities, Transformative Climate Communities, and the Infill Incentive and Infill Infrastructure Grant programs. This boosts the chances that prohousing places win funds for homes and infrastructure.

Broader prohousing policies, with point limits

The law widens what counts as a prohousing policy. Examples include less parking, faster permits, higher-density zoning, easier ADUs, lower impact fees, and converting commercial sites to homes. It also recognizes safe parking and camping, and faster approvals for navigation centers, shelters, and supportive housing. But points for those shelter‑focused policies cannot be higher than the minimum points for policies that directly help plan, approve, or build homes.

Easier path for small rural towns

Starting with the seventh housing element cycle, HCD reviews a small rural town’s housing element materials on request to find prohousing policies. The town must already have a compliant housing element. Small rural jurisdictions do not have to renew their prohousing status for at least four years. HCD can still revoke a designation for cause.

State sets and shares designation rules

HCD adopts emergency rules by July 1, 2021 to run the prohousing designation, and they stay in place until permanent rules take effect. By January 1, 2021 and every year, HCD posts the list of programs that give extra points to prohousing places. HCD names which jurisdictions are prohousing and reports that list each year and when asked to the Office of Land Use and Climate Innovation and other agencies.

Timing rule tied to SB 262

A backup version of the law takes effect only if three things happen. Both this law and SB 262 must be enacted and effective by January 1, 2026. Each must amend Government Code section 65589.9, and this law must be enacted after SB 262. If all conditions happen, Section 1.5 applies and Section 1 does not.
