Utilities and their contractors must have an AED at any worksite where two or more workers handle lines of 601 volts or more. They must adopt a written AED program in their injury prevention plan. The program requires calling 911 and reporting AED use to the local EMS agency, and training all employees, contractors, and subcontractors. They must also follow Health and Safety Code section 1797.196 for AED upkeep and related duties. The rule covers electrical corporations, electrical cooperatives, local public utilities, and their contractors.
The state does not reimburse local agencies for costs of this AED mandate. Local publicly owned electric utilities and school districts must cover any costs through local fees or budgets.
If you use an AED in good faith and are not paid for that aid, you are not liable for civil damages. You keep this unpaid status even if you are paid for other, unrelated work. A utility or its contractors that get an AED and reasonably follow the law’s rules are also not liable for emergency AED use. These immunities do not apply in the specific situations listed in Civil Code section 1714.21(e).
