Hotels and motels face civil penalties when sex trafficking occurs on-site and a supervisor knew or recklessly ignored it and failed to notify within 24 hours, or when an employee benefits through work from a trafficking venture. Fines are $3,000 for a first violation, $10,000 for a second within 24 months, and $15,000 for a third or later within 24 months. For a fourth or later violation, a court may raise the fine up to $25,000 based on culpability and ability to pay. The Attorney General or local prosecutors may enforce, fines go to the Survivors Support Fund, and employees are not personally liable. Cases must be filed within five years, or within five years after the victim turns 18.
The Office of Emergency Services funds up to 11 counties to vertically prosecute human trafficking cases. Counties must dedicate at least half of one deputy district attorney’s time and half of one investigator’s time to these cases, partner with advocacy groups, and report case results each year. Funds supplement existing resources, and up to 10% may cover state administrative costs. The Office must report program outcomes by January 1, 2028.
The law makes invasive peering and secret recording of a person’s private body parts or sexual acts a crime. It also makes it a crime to share intimate images when you know, or should know, it will cause serious emotional distress and the person does suffer distress. Covered places include bedrooms, bathrooms, and changing rooms, and it applies when images are taken secretly or shared against an agreement to keep them private. Limited defenses include lawful reporting, court orders, and public proceedings.
The Victim Compensation Board runs a grant program for community groups that serve sex trafficking survivors. Eligible groups are led by survivors or guided by strong survivor input and serve areas with high trafficking. A Survivors Support Fund in the State Treasury holds the money for these grants. Grants are available only when the Legislature appropriates the funds.
If you run a listed business (for example, hotels, transit stations, ERs), you must post the DOJ human trafficking notice where the public can see it. The notice must be 8.5×11 inches, in 16‑point font, include the Be Free text line (233‑733) and the National Human Trafficking Hotline, and be in English, Spanish, and a third local language when required. DOJ supplies the model notice (initial by April 1, 2013; updated by January 1, 2019), and you must post the update on or after January 1, 2019. If you do not comply, you can be fined $1,000 for a first offense and $2,000 for each later offense, after notice and a 30‑day chance to fix; fines go to the Survivors Support Fund. If you operate an intercity rail, light rail, or bus station, you must give at least 20 minutes of trafficking training to covered staff by January 1, 2021 and going forward; an employee’s failure to report alone does not make the business liable.
It is illegal to loiter in public with intent to buy commercial sex; examples include circling an area or repeatedly stopping. This offense carries a $1,000 fine. If you give money or something of value to buy sex in violation of the law, you also face a $1,000 fine. These fines are deposited into the Survivors Support Fund.
