If you are convicted of an offense that triggers a state gun ban, you must give up all guns you own or control. If you are out of custody within 48 hours, you must surrender within 48 hours. If you are in custody at any time in those 48 hours, you have 14 days. The court gives you a form to name someone to surrender, sell, or transfer your guns. You must file the completed form and receipts with probation on time. Missing the filing deadline is an infraction with a fine up to $100. Police update state gun records and hold surrendered guns for 30 days. This applies beginning January 1, 2026.
The law lists when a minor may have a gun with parent approval or supervision. It covers lawful shooting sports, hunting, ranch or farm use, training, and film or theater work, and travel directly to and from those activities. It applies when the minor is with a parent or a responsible adult with prior written consent, or is at least 16 with written consent. It also applies on a parent’s land with written consent. In some cases, only guns that are not handguns or semiautomatic centerfire rifles are allowed.
Starting January 1, 2026, an independent California lawyer (a special master) must conduct searches of documents held by lawyers, doctors, psychotherapists, or clergy when they are not suspected of a related crime. The special master keeps information confidential and handles privilege claims in court. They serve without pay and are treated like a public employee for claims. Court rules pause timelines while privilege issues are decided.
Judges can issue a search warrant on more listed grounds. Examples include guns or ammo tied to bans or protective orders, stolen property, child sexual exploitation evidence, tracking device data, some blood tests for driving crimes, and vehicle recorder data after serious crashes. This takes effect January 1, 2026. It can aid investigations but may also lead to more searches.
