On highways, you must move over or slow when you pass a stopped vehicle showing warning lights or devices. If you can safely change lanes away, do it; if not, slow to a safe speed for the weather, road, and traffic. This covers emergency vehicles, tow trucks with amber lights, marked road maintenance trucks with amber lights, and any vehicle using hazard lights, cones, flares, or reflectors. Road maintenance trucks include government and contractor vehicles. The rule does not apply if the stopped vehicle is not next to the highway or is behind a protective barrier. Follow a peace officer’s directions if they differ.
If you do not move over or slow as required, you commit an infraction. The fine is up to $50 each time. This applies when you fail to change lanes when it is safe and legal, or fail to slow when you cannot safely change lanes.
