Beginning January 1, 2025, an employer or union can ask a court for a restraining order to protect a worker from harassment, threats, or violence at work. The law covers more people, including board members, volunteers, and independent contractors at the worksite. The worker may choose not to be named, and the order can also protect other coworkers and, for good cause, some family or household members. Temporary orders last up to 21 days, hearings happen within 21 to 25 days, and after-hearing orders can last up to three years and be renewed for three more years. Ask for renewal within three months before the order ends.
Beginning January 1, 2025, courts must quickly send workplace protective orders to the Department of Justice or a local agency, usually within one business day. Police can check order status, give verbal notice that counts as service at an incident, and enforce the order on the spot. People under these orders cannot own, buy, or have guns or ammunition while the order is active, and the court orders surrender. Intentionally violating these orders is a crime. Courts and parties use simple Judicial Council forms for filings and orders.
The law increases penalties for battery against public transit workers and passengers. It covers operators, drivers, station and ticket agents, and employees or contractors when they are doing their jobs, and passengers. Penalties include up to a $10,000 fine and up to one year in county jail. If injury occurs, punishment can be up to a $10,000 fine, up to one year in county jail, or 16 months, two years, or three years in state prison.
Beginning January 1, 2025, you pay no court filing fee when your petition says someone harmed, threatened, or stalked you at work, or put you in reasonable fear. There is also no fee for related subpoenas or for filing a response. Sheriff or marshal service of these orders is free when the order is based on stalking, unlawful violence, or a credible threat of violence.
