Protected time for jury and court

The law protects your job when you take time for jury duty or to appear under a subpoena. Victims can take time to get court orders or other relief now. Beginning January 1, 2026, victims and some family members can take time to attend crime‑related court hearings. Preserved rules also protect victims of listed serious crimes and victims or family who attend proceedings for acts on or before December 31, 2025; those rules remain until January 1, 2035. Give notice when you can; if not, provide court, police, or prosecutor paperwork on request. Employers must keep records private and cannot retaliate.

Stronger sick day rights for workers

You get stronger rights to use paid sick days. You can use sick days for more victim‑ and court‑related reasons starting January 1, 2025, with more added on January 1, 2026. This does not change how much sick time you earn. Outdoor farmworkers can use sick days to avoid smoke, heat, or flooding during a declared emergency, including when worksites close. Your employer cannot require you to find a replacement to use sick time. If your employer punishes you within 30 days after you file a sick‑leave complaint, help an investigation, or oppose an illegal policy, it is presumed retaliation.

Protections take effect immediately

The act takes effect right away. Agencies move quickly to put the rules in place. Workers and victims get access and clarity now.

Job-protected leave and safety for victims

Employers with 25+ workers must allow job-protected leave and safety help if you are a victim or have a victim in your family. You can take time for protective orders, medical care, counseling, shelter or services, safety planning or relocation, legal help and hearings, and child or dependent care. Employers must offer reasonable safety accommodations and meet with you in good faith; they may ask for proof and recertify every six months; records stay confidential. You may use paid vacation, sick time, or comp time; employers may cap total leave at 12 weeks, and some family‑care leave at 5 or 10 days; FMLA/CFRA time runs at the same time when you are eligible. Remedies include reinstatement and back pay; for acts on or before December 31, 2024, you can file with the Labor Commissioner within one year and willful refusal to rehire is a misdemeanor; those preserved rules last until January 1, 2035. The Civil Rights Department must post a model notice by July 1, 2025; employers must give written notices once that form is posted.
