Legal shield for involuntary-hold staff

The law protects certain facility leaders, designated clinicians, and peace officers from civil and criminal lawsuits for actions taken by a person they release at or before the end of the hold. The protection applies to releases from involuntary mental health treatment. Existing exceptions in the law still apply. This lowers legal risk for facilities and staff who make release decisions.

New county rules for hold designations

County behavioral health directors set who can be designated to perform involuntary mental health hold duties, what licenses and experience count, and how to apply, renew, and be reviewed. Counties may create training and testing for these roles. When a county denies or revokes a designation, it must send a written notice with reasons to the requester and the person named in the request. Designated mobile crisis team members and other designated professionals may transport people taken into custody. Counties must include emergency physicians as an eligible group. An “emergency physician” is a doctor who screens and treats patients in a hospital emergency department.

Sacramento must designate city crisis staff

If Sacramento County adopts these procedures, it must issue a written policy by April 1, 2022. The county must designate City of Sacramento mobile crisis team members or other professional staff when the City asks in writing, the workers meet the county rules, and they complete any required county training. This creates a clear path for city staff to serve under county designations.
