State can keep delisted rivers protected

When the federal government removes, delists, or exempts a California river, the state can act. The Natural Resources Secretary holds a public hearing to share information and take comments. Based on that input, the Secretary decides whether to add the river to the state wild and scenic system and how to classify it. If added, the state protection starts the same day.

Limits on new state river protections

State protections created this way stay within the old federal boundaries and scope. They cannot conflict with the former federal designation or a river management plan. The Legislature can later pass a law to remove, change, or reclassify the state designation.
