New licensing rules for drug dispensing machines

All automated drug dispensing systems in California must be licensed by the state board. Only pharmacies with a current California pharmacy license can hold these licenses, and each device needs its own license. The board inspects the site within 30 days of a complete application; moving a device needs a new license, and replacing a device needs written notice within 30 days. Licenses cancel if the pharmacy license is not current; operators must notify the board within 30 days if they stop using a device and renew each year on the pharmacy’s renewal date. To get licensed, the site must be secure and the pharmacy must have anti‑theft, inventory monitoring, and loss‑reporting policies. Some machines do not need an ADDS license: in‑hospital unit dose systems used only for inpatient doses (or dispensed under Section 4068) that are owned or leased by the hospital pharmacy, and technology inside the secured pharmacy used to select, count, package, and label drugs. Hospitals must still follow other ADDS rules and keep a list of unit‑dose machine locations.

Emergency patients can take needed meds home

If the hospital pharmacy is closed, your ER prescriber can give you medicine to start or keep treatment. The drug must come from the hospital’s supply, and the prescriber must believe no outside pharmacy is available. You can get up to a 72‑hour supply, with full labels, and the hospital must keep records and report Schedules II–IV as required. When you are discharged, the prescriber can give you the unused part of a non‑controlled drug you were given in the ER from single‑patient multidose packaging (like an inhaler, eye/ear/nose drops or sprays, topical, or liquids) if you need it to continue care. The prescriber is responsible for any dispensing or labeling mistakes.
