The Department of Toxic Substances Control must update the Homeowners' Guide to add sections on wildfires, climate change, and sea level rise. The guide also adds a section on thirdhand smoke, how to assess it, and how to reduce it. DTSC assigns San Diego State University's Center for Tobacco and the Environment to draft the smoke section using existing staff and research when available. DTSC reviews the draft to ensure it explains risks, fixes, and where to learn more. DTSC seeks help from Natural Resources Agency departments. Updates happen as existing resources or private funds allow. The law defines thirdhand smoke as toxic residue left behind by tobacco smoke.
If you sell a single-family home and you actually know it has tobacco or vape residue, you must tell the buyer in writing. Residue can be shown by the smell of smoke or by tests showing nicotine on surfaces or in dust. Electronic cigarettes and vape devices count as smoking. This duty is on top of other required seller disclosures. Buyers get clearer health and cleanup information before they close.
