The sale papers must include a signed rental agreement or a signed statement of agreed terms. If you do not sign the rental agreement, you have no tenancy rights. If you lack tenancy rights and refuse to leave for 5 days after a demand, you are an unlawful occupant and can be evicted. But if you are the registered owner and management approved you, failed to notify you so you are deemed approved, or did not offer you a rental agreement, you are not an unlawful occupant.
The law limits what repairs a park can require when a home is sold and stays in the park. Management can require work only for exterior items that a cited law, rule, or code requires, and not for items it owns or installed. If you ask, management must send a written list with legal citations within 15 business days as part of the required sale notice. If they miss this, their repair demands are waived, except for health and safety repairs required by law.
Sellers must notify park management about a sale before closing. Within 15 days, management must give both sides its approval rules, any minimum credit score, and the full document list. Management may deny only for past rule violations, lack of ability to pay rent, estimated utilities, and charges, or fraud. It cannot require tax returns and may ask only for documents on its list. After you submit all info, management must decide in 15 business days or you are approved. If denied for finances, you can submit assets like savings or stocks, which management must consider. Any fee for a credit or financial report goes to your first month’s rent, or is refunded within 30 days if you are rejected; if you are approved but do not buy, management may keep the fee to cover costs. If management breaks these rules, the seller can recover damages.
Sales of homes that stay in a park must use the state’s mobilehome Transfer Disclosure Statement. This gives buyers standard information about the home. If management asks in writing, the seller must give it a copy.
