Faster occupancy for detached ADUs after disasters

Local agencies normally cannot issue an ADU occupancy certificate before the main home’s certificate. In a county under a Governor-declared emergency issued on or after February 1, 2025, there is an exception. If the main home was substantially damaged or destroyed by that emergency, a detached ADU can get its certificate. The ADU must have building permits and pass all required inspections. This does not apply to ADUs attached to the main home.

Faster coastal permits for ADUs statewide

For ADUs in the coastal zone, a complete coastal permit must be approved or denied within 60 days. Cities process the coastal permit at the same time as the ADU approval and do not have to hold a public hearing. If a city has no certified local coastal program, the California Coastal Commission must decide in 60 days after it gets the complete application. The city must tell the Commission when your application is complete. If the Commission does not act in 60 days, the ADU coastal permit is automatically approved. If you filed the ADU permit with a permit for a new house or apartment on the same lot, the Commission can wait and decide the ADU after it acts on the new home permit. Local decisions under this process are final and cannot be appealed under the standard coastal appeal rules. These rules apply to all cities, including charter cities.
