The law creates a looting crime for certain theft and burglary during a declared state or local emergency, or under an evacuation order, in the affected county. Inside an evacuation zone, burglary can be charged as first degree, with 2, 4, or 7 years in state prison. Other listed theft offenses can mean up to one year in county jail or terms under Penal Code 1170(h). Grand theft of a firearm is punished in state prison, and petty theft can carry six months in county jail. Evacuation zones include areas under evacuation or warning, damaged or destroyed homes for up to one year, and homes under rebuilding for up to three years. The law repeals the prior looting section and replaces it with updated definitions and rules. These rules become operative only if Senate Bill 571 is enacted and effective by January 1, 2026.
For burglary, a home is inhabited if it is used as a dwelling, even if no one is home. It still counts as inhabited if people left only because of a disaster. Damage from a disaster does not block a burglary conviction. These rules become operative only if Senate Bill 571 is enacted and effective by January 1, 2026.
If a court gives probation for a looting offense, it must set minimum jail time. Most offenses require at least 180 days in county jail. The offense in subdivision (b)(4) requires at least 90 days, unless the judge reduces it on the record. The court may also order up to 240, 160, or 80 hours of community service, depending on the offense. These rules become operative only if Senate Bill 571 is enacted and effective by January 1, 2026.
Consensual entry into a commercial building to commit certain fraud crimes is not charged as looting. The excluded crimes include forgery, bad checks, and card fraud listed in Penal Code 470, 476, 476a, 484f, and 484g. These rules become operative only if Senate Bill 571 is enacted and effective by January 1, 2026.
