Stronger records and police reporting for dealers

Junk dealers and recyclers must keep a written record for every buy or sell. The record must list the place, date, time, amount paid, and the employee. It must include seller ID (driver’s license or other allowed ID), the vehicle plate that brought the items, any buyer’s name and address, a clear item description with weight and serials, and a signed owner statement. Dealers must send this information to the local police chief or sheriff as the law requires. Lying on these records is a misdemeanor.

Tougher checks and penalties for utility metals

It is a crime to buy or receive wire, cable, copper, lead, solder, mercury, iron, or brass used by railroads, utilities, or public entities without due diligence to confirm the seller’s right to sell. Dealers must get the seller’s name, signature, address, driver’s license number, and the delivering vehicle’s plate. The purchase record must describe the material and be kept as the law requires. Penalties include fines up to $1,000, up to $5,000 in some cases, and up to one year in county jail.

No public property scrap without written proof

Dealers cannot possess certain items from public agencies without a written certification on agency letterhead. Examples include hydrants, manhole covers, street lights and signal gear, wiring and fiber, EV chargers, and water meters. If these items show up in a mixed load without certification, set them aside, tell police by the end of the next business day, and do not sell them until police decide. A valid certification sent by email, fax, in-person letter, or certified mail protects you from penalties for that item. Knowing possession of stolen agency items, or failing to report as required, is a crime with fines up to $5,000.
