It is illegal to hire runners, cappers, or steerers to find clients or patients for workers’ comp or insurance claims. Violators face $5,000 to $10,000 per violation plus up to 3 times each claim amount, and courts can block illegal payouts. Private people can sue in the state’s name. If officials take the case, the private filer gets 30%–40% of the recovery; if not, they get 40%–50%.
The law expands who can be covered under one blanket policy, like schools, sports teams, employers, volunteer fire groups, travel carriers, and entertainment companies. Coverage can include death, dismemberment, and hospital or medical costs from an accident or sickness. The policy insures everyone in the described group, and covered people get a certificate. Insurers can use a short filing when only the group, covered people, or activities are new. A prior section is repealed and replaced by these rules.
You may not sell or resell an insurer’s securities unless the insurer has a permit from the Insurance Commissioner. Brokers and stock agents must hold the right certificates and follow stricter definitions of sales and who counts as a broker or agent. A stock agent certificate expires on the first July 1 after it is issued. Broker applicants must file detailed information and a $5,000 bond. Fees: $283 for a broker’s first office plus $136 for each extra office; $136 for a stock agent application. The Commissioner can suspend or revoke certificates for bad repute, violations, or fraud.
The State Compensation Insurance Fund may invest like private insurers, with clear limits. It can put up to 20% of excess moneys into listed investments and may buy state bonds and PACE bonds. Discretionary investments are capped at the lesser of 2.5% of admitted assets or 10% of excess moneys. Its money market funds may not hold foreign assets. Older investment rules are repealed and replaced.
The law clarifies what a vehicle service contract can cover. It can include some motor homes and trailers, routine maintenance of at least 12 months, and extras like towing, rental car, road service, and deductible or travel reimbursements. Companies filing sample contracts must certify these indemnity benefits are only incidental and may have to show data. It also allows tire and wheel, glass, dent repair, and key replacement agreements.
Insurers may not market an accelerated death benefit as long‑term care, nursing home, or home care insurance. Ads must say it is a life insurance feature, not long‑term care, not a Partnership policy, and not a Medicare supplement. Ads must explain tax treatment and compare it to long‑term care coverage. Beginning January 1, 2014, insurers must file ads with the Insurance Commissioner before use, who may disapprove them.
Some fraternal benefit society representatives do not need the usual licensing exam. This applies to certain long‑tenured reps and to part‑time reps who do not work full time selling life or health insurance. If a part‑time rep later plans to work full time, the society must notify the Commissioner and an exam will be set.
Insurers must execute bail only through licensed bail agents. Only licensed people may solicit or sign bail undertakings, including ads that imply licensure. Employers must ensure bail fugitive recovery agents are licensed. Fugitive recovery licensees must carry ID; some felony convictions bar a license.
Applicants must submit fingerprints; the Insurance Commissioner gets state and federal responses. If a license is neither issued nor denied within one year, the application is automatically denied unless kept open for good cause. You must notify the Commissioner in writing within 30 days of new convictions, pending felony charges, administrative actions, or findings of fraud. Business entities must also report changes to listed unlicensed persons.
A limited cargo shipper agent license lets you buy cargo insurance for the client you serve and handle paperwork and claims help. There is no exam or prelicensing or continuing education. You pay $29 for each year or part of a year of the license term.
