The law gives alcohol licensees a defense in criminal cases and license actions when they check ID. They must have asked for, seen, and relied on an acceptable ID, or used a biometric system. Using an age-check device or software can still help as evidence even if it misses a fake. This applies only when the ID is bona fide, was physically inspected, looked real, and matched the customer.
The law lists what counts as proof of age. A government photo ID with name, birth date, and description counts. A U.S. or foreign passport or a military ID with a birth date and photo also count. If you use a biometric system, it must verify the ID and link it to the customer’s biometrics. Scanning means reading the card’s magnetic stripe or barcode to check the data.
